The four MLAs who won the assembly by-polls took will take oath on monday. Speaker Biman Banerjee made the announcement in the Assembly on Monday. The same night, the Raj Bhavan again mentioned the swearing-in of the two MLAs as unconstitutional without naming them and mentioned a fine of Rs 500 each. So, ahead of the swearing-in of the four MLAs on Tuesday, the mercury of more controversy has started to rise.
"On behalf of the Raj Bhavan, the Deputy Secretary informed the office of the Speaker about the constitutional provisions regarding the oath-taking ceremony and the constitutional eligibility of the oath-taking ceremony," the Raj Bhavan said in a statement. Those who have not taken oath in accordance with the constitution will be fined if they join the session. " It has also been mentioned in the X-handle that the Raj Bhavan has informed the Speaker about this under any section of the law. Under Section 193, if a member of the Legislative Assembly participates in the session without taking oath in accordance with the constitutional norms, the concerned member will have to pay a fine of Rs 500 per day for the number of days he attends the session or participates in the voting.
Meanwhile, the Raj Bhavan has sent letters to Baranagar MLA Sayantika Banerjee and Bhagwangola MLA Rayat Hossain Sarkar. In a letter to the two MLAs, the Raj Bhavan said their oath was taken unconstitutionally. The letter also mentions the punishment that can be meted out if Sayantika and Reyat participate in the assembly voting. Governor Bose mentioned a total of 37 points. He said the Speaker has no jurisdiction to administer the oath of office to the Governor. In the letter, Bose asked Sayantika-Rayet who administered the oath to them. He also said that if the Deputy Speaker does not take oath as per his instructions, it is unconstitutional.
The letter also said that a fine of Rs 500 each could be imposed on the two MLAs. Sayantika Rayat said she would inform the Speaker about the matter. In the June 4 by-election, Sayantika won from Barahanagar and Reyat from Bhagwangola. But their swearing-in was delayed by nearly a month due to the Raj Bhavan-Assembly row. Speaker Biman had called a one-day session of the Assembly on July 5 and administered the oath. Deputy Speaker Ashish Banerjee was administered the oath of office by Governor Banwarilal Purohit. But when he refused to take oath in the session, the Speaker administered the oath. Recently, when the Assembly Secretariat sent a letter to the Raj Bhavan for the swearing-in of the four MLAs, the Raj Bhavan responded by asking whether his constitutional order was followed in the swearing-in of the two MLAs.
The Speaker announced the swearing-in of the four MLAs on Tuesday, saying there was no response from the Raj Bhavan on Monday. And since the statement was released at the Raj Bhavan on Monday night, the businessmen of Bengal politics are looking at whether there is any complication in the swearing-in of the four MLAs.
