Court didn't say CM's remarks defamatory: Mamata's lawyer on Bose case

West Bengal Governor CV Anand Bose has filed a defamation case against Chief Minister Mamata Banerjee. After hearing the case, the Calcutta High Court on Tuesday said that no derogatory remarks can be made about the Governor. The Chief Minister's lawyer, Sanjay Basu, later retracted his statement.

"The court did not say anything about the statement of the chief minister which was filed as defamatory," the statement said. " At the same time, the Chief Minister herself is a woman and a public representative. If he knows the pain of women, it is his duty to stand by them. The statement of the Chief Minister's lawyer also mentioned the constitutional right to freedom of speech.


Bose had filed a defamation case against the chief minister in the Calcutta High Court. Two TMC MLAs, Sayantika Banerjee and Rayat Hossain Sarkar, and Trinamool leader Kunal Ghosh were also named in the case by the governor. The case was heard in the court of Justice Krishna Rao on Tuesday. The court observed that, according to the claim of the plaintiff, his reputation has been tarnished by a number of comments. Such comments should be avoided. If the interim order is not granted at this stage, the plaintiff will be encouraged to make defamatory statements against the plaintiff. Justice Rao had earlier directed that media reports on Chief Minister Mamata Banerjee's comments on Governor Bose be added to the case. "It has to be admitted that the litigant is a constitutional authority. The allegations made against him have been published in various media. " The court further observed, "The plaintiff has made a prima facie case and to grant an interim order at this stage would amount to allowing the defendant to continue with the defamatory statement. This can affect the reputation of both parties. "
